Our Asset Tracing investigations seek to identify, locate and arrange to recover assets belonging to our clients. Asset Tracing is used in several circumstances, including assessing whether a respondent has satisfactory assets to make the costs of proposed litigation worthwhile, estimating realisable assets that may be recovered following a successful Court judgment, locating assets which may have been taken or stolen fraudulently, or providing suitable evidence of assets held by a party during negotiations to recover or settle unpaid debts.

We have successfully assisted clients and their legal advisors with the identification of various types of assets ranging from landed property, through to bank accounts and share trading accounts. These assets may be directly or indirectly owned or controlled by individuals and / or corporate entities seeking to hide their true origins, and we often find ourselves conducting investigations in countries different to those that the assets went missing from.

Our Asset Tracing investigations include both on the ground field investigation and further research; we conduct interviews with those familiar with the subject to obtain possible leads, and perform in-depth investigative research on the subject and their close associates who may harbour assets on their behalf. During our Asset Tracing investigations, we frequently locate and identify bank accounts, trading accounts and offshore trust structures, although transaction details can only be accessed with legal authority. Once these and any other assets such as land, property, shareholdings, vehicles, vessels, plant and equipment etc. are identified, we can brief legal counsels and assist with the creation and implementation of strategies for appropriate action to further identify assets, secure their recovery and / or seek restitution via negotiation.

Once we have identified the quantum, type and location of the assets, further action will need to be taken to affect recovery, which may involve civil or criminal courts, a negotiation process between the parties or intervention by government agencies or regulators.
